Violation Description: On 27 March 2018, the Care Inspectorate made an application to the Sheriff at Dumbarton seeking cancellation of the care service's registration under section 65 of the Public Services Reform (Scotland) Act 2010 ("the Act"). The application was based on the Care Inspectorate's belief that in the absence of an order, there would be a serious risk to the life, health or well-being of persons. As part of the application, the Care Inspectorate also sought an interim order, suspending the registration of the care service under section 65(3) of the Act. At an interim hearing on 10 April 2018, the care service gave a formal undertaking to the court that it will not enter into any contract or arrangement to accept any residents whatsoever, however funded, at Clydeview Care Home without the express prior consent in writing of the Care Inspectorate and the Argyll & Bute and West Dunbartonshire Councils and Health & Social Care Partnerships. On that basis the Care Inspectorate did not consider it necessary to ask the court to make an order suspending the registration.
